Terms of Agreement

Terms of ConsignmentThe consignment term will be for 1 year from October 1, 2023 (or date of goods received) – October 1, 2024. If any of the items remain unsold at the end of the consignment term the vendor will send them back to Trick Mantra.

CommissionThe consigned products will be for sale with a commission of 50% to Trick Mantra and 50% to the vendor.

Commission PaymentsCommission payments are made the month following the sale of the consigned product(s).

PricingThe vendor shall offer the consigned product at the retail price listed on the below list of consigned products. The retail price includes the vendor’s sales commission of 50%. Any change in the retrail price must be agreed upon by both parties and documented in writing with seven business days advanced written notice.

ShippingThe vendor is responsible for paying for the shipping of the products to the retail store. Should any products remain unsold by the end of the agreed terms, the vendor will pay return shipping to Trick Mantra.

Responsibility for Loss or Damage & Insurance CoverageVendor shall be responsible for the safekeeping of consigned products while they are in its custody and will pay Trick Mantra for any lost, damaged or stolen products as if the product had been sold.

ReproductionThe vendor may publicize & promote the availability of the products through social media, the vendor’s website, print advertising and email newsletters, and in general marketing and promotional materials of the retail store. In every instance of such use, Trick Mantra shall be acknowledged.

Termination of AgreementNotwistanding any other provision of this agreement, the agreement may be terminated at any time by the vendor or Trick Mantra by means of written notification of termination from either party to the other. Within 45 days of the notification of termination, all accounts shall be settled, and all unsold products shall be returned at the expense of the cancelling party.

Procedures of ModificationAmendments to this agreement must be signed by both the vendor and Trick Mantra and attached to this agreement. Both parties must initial any deletions made on this form and any additional provisions written into it.
